Terms
Terms, in plain words
Plain-English first draft written for review. It has not been checked by a lawyer or an accountant. Points marked "Open point" are not decided yet. The earning terms for authors are deliberately not written here: they will be a separate document, published before launch.
Last updated: Open point: date at publication
1. Who we are
GamesGarden is a free browser games site. In these terms, "we" and "us" means GamesGarden Open point: the legal entity that runs the site, its address and contact. "You" means anyone who plays a game or sends us an idea.
2. Playing the games
- Every game on GamesGarden is free to play in your browser. You don't need an account.
- Please play fair. Don't try to break, overload or trick the site, the leaderboards or other players' games.
- We look after the games and may change them, tune them, pause them or take them down. When a game's rules change, we try to keep old scores fair.
- The games are provided as they are. We work hard to keep them running, but we can't promise they will always be available or free of bugs.
3. Garden names and leaderboards
- A garden name is optional. Pick one only if you want to appear on the leaderboards or keep your progress.
- Please pick a name that is kind. No real people's names unless it is your own, no rude words, nothing that pretends to be us. We may change or remove a name that breaks this.
- Your garden key is like a house key. Anyone who has it can use your garden name. Keep it safe; we can't read it back for you.
- A score counts only after our server has checked it. We may remove scores that we believe were not played fairly.
- You can delete your profile at any time from your garden. What happens to your data is explained in our privacy page.
4. What belongs to whom
- The games, their names, art, sounds, code and look belong to GamesGarden (or to the people who licensed parts of them to us, credited in each game).
- You may share links to our games freely. Please don't copy the games themselves or put them on another site.
5. Ideas you send us ("planting a game")
Open for early testersThis part applies to every seed you plant. The planting form is open for early testers.
When you send us an idea for a game:
- No obligation to build. Sending an idea doesn't mean we will build it. Most ideas will not be built. We don't have to tell you why.
- We may already be working on something similar. We make lots of games and receive lots of ideas. We may already be working on a similar idea, from our own plans or from another player, and we may build a game like yours without it coming from you. Sending an idea doesn't stop us doing that.
- An idea alone creates no rights. Ideas on their own can't be owned. Sending one doesn't create a partnership, a job or any right to a game, unless we agree something in writing.
- We own the game we build. If we build a game from your idea, GamesGarden designs, draws, builds and owns that game, including its name and look. That keeps one owner who can look after it, fix it and keep it running for everyone.
- You get the credit. If we build a game from your idea, we will credit you as its author with your garden name on the game's tile and page, for as long as the game is in the garden, unless you ask us not to.
- Earning terms come before launch. Authors share in what their game earns. The exact terms, including how it is worked out, when it is paid and who can be paid, will be published before launch, and nothing is paid under these terms until you have agreed to them. Open point: all earning terms, the payee entity and the payout provider
- What you send must be yours to send. Don't send someone else's game, its name, its characters or its look. Please describe what you love about a famous game in your own words instead.
- Using what you send. You let us read, keep, store and discuss your idea, and use it to decide what to build, now or later. We keep every idea, even ones we don't build.
- Your email, if you choose to give one. You never need an email to play or to plant a seed. If you give us one for your seeds, we use it only to tell you about your seeds, like a reply from us. We never use it for marketing, never show it on the site and never share it. You can turn the emails off or remove your email any time on My seeds, and deleting your garden deletes it. See the privacy page.
- Open point: a minimum age, or a parent or guardian's consent, for authors who may be paid.
6. Things for sale (coming later)
Nothing is for sale on GamesGarden yet. If we add a Garden Pass or in-game helpers, their prices and terms will be shown clearly before you pay for anything. Nothing you can buy will ever change a score or a place on a leaderboard. Open point: purchase, cancellation and refund terms
7. Ads (coming later)
There are no ads on GamesGarden yet. When ads arrive, they will include optional videos you can watch for a bonus and short breaks between rounds. We will update the privacy page and ask for your consent first.
8. Changes to these terms
We may update these terms. When we make a change that matters, we will say so on the site. The date at the top shows the latest version.
9. Law and contact
Open point: governing law, jurisdiction and contact address
